Using one of our apps?

The terms below cover our website and client work. If you use one of our iPhone or iPad apps, that app's own terms of use apply, together with the Apple Standard End User License Agreement. They include the subscription terms (auto-renewal, cancellation and refunds through Apple).

Native iOS application development (Swift & SwiftUI)
iCloud / SwiftData integration and persistence
Subscription and in-app purchase setup
UI/UX design and prototyping
App Store optimization and localization
App submission, review handling, and post-launch maintenance

3. User Obligations

3.1 Eligibility

You must be at least 18 years old or have the legal capacity to enter into contracts in your jurisdiction to use our services.

3.2 Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

Use our services for any illegal or unauthorized purpose
Violate any applicable laws or regulations
Infringe upon the rights of others
Transmit any harmful, offensive, or inappropriate content

4. Service Agreement and Development Process

All mobile application development projects will be governed by a separate written agreement that outlines the specific scope, timeline, deliverables, and payment terms.

4.2 Client Responsibilities

Clients are responsible for:

Providing clear project requirements and specifications
Timely feedback and approval of deliverables
Providing necessary assets, content, and access
Making payments according to agreed terms
Ensuring they have rights to all provided materials

4.3 Our Responsibilities

We are responsible for:

Delivering services according to agreed specifications
Maintaining professional standards and quality
Providing regular project updates
Protecting confidential information
Meeting agreed-upon deadlines

5. Intellectual Property Rights

5.1 Client-Owned IP

Upon full payment, clients will own the intellectual property rights to the custom mobile applications we develop for them, subject to any third-party licenses.

5.2 Our IP

We retain ownership of our proprietary tools, methodologies, frameworks, and general know-how used in the development process.

5.3 Third-Party Components

Applications may include third-party libraries, frameworks, or APIs subject to their respective licenses and terms.

6. Payment Terms

6.1 Fees and Payment

Payment terms will be specified in individual project agreements. Generally, we require:

A deposit before project commencement
Progress payments tied to project milestones
Final payment upon project completion

6.2 Late Payments

Late payments may result in project suspension and additional fees. We reserve the right to charge interest on overdue amounts.

6.3 Refunds

Refund policies will be outlined in individual project agreements. Generally, work completed and approved is non-refundable.

7. Warranties and Disclaimers

7.1 Service Warranty

We warrant that our services will be performed in a professional manner and will substantially conform to agreed specifications.

7.2 Disclaimer

Except as expressly stated, our services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted service or error-free operation.

8. Limitation of Liability

To the maximum extent permitted by law, mk0.net shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption.

9. Confidentiality

We agree to maintain the confidentiality of all proprietary and confidential information shared by our clients. Confidentiality agreements may be executed separately for specific projects.

10. Termination

10.1 Termination by Either Party

Either party may terminate services with written notice as specified in individual project agreements.

10.2 Effect of Termination

Upon termination, payment for completed work will be due, and both parties will return or destroy confidential information as appropriate.

11. Force Majeure

Neither party shall be liable for any failure to perform due to unforeseen circumstances or causes beyond their reasonable control, including but not limited to acts of God, natural disasters, pandemics, or government actions.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes will be resolved through good faith negotiation, and if necessary, through binding arbitration.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services constitutes acceptance of modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
