DMCA & Copyright Notice

1. Our position on copyright

mk0.net respects the intellectual property rights of others. We expect users of our iOS applications to do the same. If you believe that any content on this website, or any user-generated content inside our applications, infringes your copyright, please follow the procedure below.

This policy is provided in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512, "DMCA"). It applies to the mk0.net website and to any iOS app published by mk0.net that allows users to upload, store, or share content.

2. Filing a DMCA notice

If you are a copyright owner (or are authorized to act on behalf of one) and believe that material accessible on mk0.net or inside one of our iOS apps infringes your copyright, you may submit a notification by email. Your notice must include all of the following:

  • A physical or electronic signature of the copyright owner or person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed (or, for multiple works, a representative list).
  • Identification of the material that is claimed to be infringing, with information reasonably sufficient to allow us to locate it: the website URL or the name of the app and a description of where the content appears.
  • Your contact information: name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

Response time: Typically within 5 business days of a complete notice

Note: Reports that do not include all required elements may be delayed or, where appropriate, declined as defective.

4. What happens after we receive a valid notice

  • We will review the notice to confirm it is complete and made in good faith.
  • For website content, we will remove or disable access to the material identified as soon as practicable.
  • For user-generated content inside an iOS app that uses local-only or iCloud storage, we may not technically be able to remove material from a specific user's device. In such cases we will work with you to identify the appropriate remedy and, where applicable, contact the user directly.
  • We will keep a record of all valid notices for our repeat-infringer policy.

5. Counter-notice procedure

If you believe material was removed or disabled in error, you may submit a counter-notice. Your counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed and where it appeared before removal.
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
  • Your name, mailing address, telephone number, and email.
  • A statement that you consent to the jurisdiction of the federal courts in the district where you reside (or, if outside the United States, of any judicial district in which mk0.net may be found), and that you will accept service of process from the person who filed the original notice.

Send counter-notices to the same address as DMCA notices, with subject prefix [DMCA Counter-Notice].

6. Repeat-infringer policy

In appropriate circumstances and at our sole discretion, we will disable and / or terminate the accounts of users who repeatedly infringe the copyrights of others. For our iOS apps that do not have user accounts (the majority), repeat-infringer enforcement may take the form of blocking specific content patterns or, in extreme cases, removing the affected feature.

7. Knowing misrepresentation

Any party that knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages under 17 U.S.C. § 512(f). Please consider this before submitting a DMCA notice.

8. International notices

If you are outside the United States and your claim is based on a non-US copyright (for example, under the EU Directive 2019/790 or similar national law), email us at the address above with subject prefix [Copyright]. We will treat the request on its merits and apply the substantively equivalent procedure.

9. Trademark complaints

DMCA applies to copyright. For alleged trademark infringement, please email [email protected] with subject prefix [Trademark] and include similar evidence of ownership and the allegedly infringing use.
